Terms of Service
Last updated 14 Mar 2023
Agreement
These Terms govern your use of Valerius Cloud websites, client portal, and services (web hosting, VDS, and SSL). By creating an account or placing an order you confirm that you have read and agree to these Terms, our Acceptable Use Policy, and our Privacy Policy.
Eligibility and identity
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter a binding contract. You must provide accurate identity and contact details. Valerius Cloud may request additional verification before activating paid services and may refuse, delay, or terminate accounts that cannot be verified or that present elevated fraud or abuse risk.
Accounts
You are responsible for safeguarding credentials delivered in the portal and for activity under your account. Notify us promptly of unauthorized access.
Orders and billing
Orders are reviewed by an engineer before invoicing. Payment is not collected at checkout. Services are billed annually in United States dollars (USD) unless a written quote states otherwise. Invoices are issued with a payment link; unpaid invoices may expire or be voided.
Provisioning
After payment is confirmed, Valerius Cloud provisions the service and delivers credentials or certificate materials in the client portal. Activation timing is typically within hours of payment but may vary with configuration complexity.
Acceptable use
Use of services is subject to the Acceptable Use Policy. Without limitation, you may not use services for illegal activity; sale or facilitation of illegal goods or services; spam; malware; unauthorized scanning; phishing; or content that violates applicable law. We may suspend or terminate services that breach this policy, with or without prior notice where necessary to stop ongoing harm.
Fair use (VDS traffic)
VDS traffic is unmetered under fair use. Sustained transfer above 3 TB in a rolling 24-hour window may be temporarily shaped to 300 Mbit/s until usage returns under the threshold.
Refunds
Refund eligibility, if any, is determined under these Terms and the Service Level Agreement. Contact support via ticket for case-by-case review. No verbal refund promise modifies this document. Fees paid for services terminated due to AUP or Terms violations are generally non-refundable.
Limitation of liability
To the maximum extent permitted by law, Valerius Cloud is not liable for indirect, incidental, or consequential damages. Aggregate liability for a claim relating to a paid service is limited to the fees paid for that service in the twelve months preceding the claim.
Changes
We may update these Terms by posting a revised version. Continued use after the effective date constitutes acceptance. Material changes may also be communicated in the client portal.
